Denis McGauran (Operations Director) of Cinergi Telecom was interviewed “live” on RTE’s “Morning Ireland” radio show on Jan 29th 2004 by presenter John Murray. Denis gave an in depth response to Minister for Communications Dermot Ahern’s welcome clampdown on Eircom’s increasing telephone line rentals. He also discussed how Eircom have been found in breach of the CPS code of practice by the Telecommunications Industry Regulator, Comreg. Here is the transcript of that interviewPRESENTER – JOHN MURRAY Now to the announcement by Minister for Communications Dermot Ahern that he is ordering ComReg to bring in a new regime for telephone line rentals that would herald the long-awaited arrival of what is know as single billing. Well one of the companies that stands to benefit is Cinergi Telecom, founded in 1999. Its director Denis McGauran joins us now. Denis McGauran what will this mean? DENIS MCGAURAN – DIRECTOR – CINERGI TELECOM It’s a welcome intervention by the minister. He wants us to be able to compete with Eircom on line rental. Cinergi guarantees savings on calls to all homes and businesses. We want to be able to do the same on line rental and we’re unable to do so at the moment. So the challenge has now been set by the minister to the regulator to deliver a product that works, and more importantly is commercially viable. JOHN MURRAY So does it mean that we say consumers who don’t want to stay with Eircom can now get a single billing arrangement with their competitors? DENIS MCGAURAN Correct all competitors will be able to offer customers one bill, one point of contact for all their telecoms needs and primarily I suppose the minister wants to drive down costs and we want to be able to do that, but at the moment we can’t. His intervention will hopefully push the regulator into giving us a product that we can reduce costs as well. JOHN MURRAY And can ComReg insist that Eircom do this? DENIS MCGAURAN Yes. JOHN MURRAY Can they issue an order that will actually force them? DENIS MCGAURAN The regulator is responsible for promoting competition and protecting the consumer. And in both cases they have the power to do this. It’s something we’ve been pushing in Cinergi for the last eighteen months and we’re now looking forward to the minister’s intervention giving us a product to offer to consumers where we can give savings as well and it’s a welcome development. JOHN MURRAY Okay in the last forty-eight hours ComReg has also found in your favour in a case you brought against Eircom for… for what we’ll call “underhand tactics on the doorsteps”, what were they doing? DENIS MCGAURAN This is a very significant announcement for competition in the market. For the last two years Cinergi Telecom has provided a continuous stream of evidence to the regulator of underhand tactics in the marketplace by Eircom. On every occasion Eircom have been allowed to pass it off as an individual representative’s error shall we say. JOHN MURRAY What were they doing? DENIS MCGAURAN They were mis-quoting our rates. They were using incorrect comparisons. They were trying to convince customers of Cinergi to return to Eircom on the basis of the customer would save money. And in every single occasion anybody who has left Cinergi to return to Eircom it has cost them money and the regulator is aware of this. We have made him aware of how we price our calls. We discount Eircom’s discounts. So the regulator had a very strong position within which to address this issue and they have for the first time in the history of the market, they have found Eircom as a company guilty of misleading consumers. And every consumer who was misled by this information has… it has cost them money. JOHN MURRAY Okay Denis McGauran of Cinergi Telecom, thank you for joining us.
